Procedure for a Mexican Divorce

Immigration has very particular requirements for recognizing a foreign
divorce. If you or the person you plan to marry is not a US citizen
and you intend to go to the INS to ask for status you will need to
have your divorce decree Certified and Stamped by the Mexican Government.

Please read carefully. Some items may not apply to you.
Here are various forms required for your divorce. You will be told in each case whether the form applies to you. Please find
Information sheet. This applies to you. Fill this out completely. The plaintiff is you, or the person seeking the divorce. The defendant is your spouse. Be sure to fill in every space. If the information requested does not apply to you please state that it does not apply to you. Do not leave any blanks on form.
Plaintiff's Special Power of Attorney. This applies to you. You do not need to fill it out, but you must sign it where indicated. You do not have to have this form Notarized.
Defendant's Special Power of Attorney. This applies to your spouse only if your spouse is also signing the papers. If your spouse is also signing then he/she must sign where indicated. You do not have to have this form Notarized. If your spouse is unwilling or unable to sign, you can disregard this form altogether.
Affidavit. This applies to you. You do not need to fill it out, but you must sign it where indicated. You do not have to have this form Notarized. This also applies to your spouse only if this is a two party case and your spouse is also signing the papers.

Certification by the United States Secretary of State that
the decree has been signed by the Court officials authorized to sign your
decree. This certification may be necessary when presenting your decree in a
foreign country in order for your to remarry there, and in some cases for
US officials questioning the authenticity of your decree. It will not ordinarily
be necessary if your are remarrying in the United States.
Expedited Service for a Mexican Divorce (7 - 8 day service): $250.00
Additional Official Court Copy of the Decree for a Mexican Divorce: $200.00
