Procedure for a Mexican Divorce
Requirements:
United States Immigration has very particular requirements for recognizing a foreign divorce. If you or the person you plan to marry is not a US citizen and you intend to go to the INS to ask for status you will need to have your divorce decree Certified and Stamped by the Mexican Government. Mexican divorce clients acknowledge that Fresh Pond Travel serves strictly as intermediary for the convenience of the client and that the client's dealings are strictly with the International Law Office of Tijuana, Mexico, to whom the client shall look for indemnification.
Please read carefully. Some items may not apply to you.
Here are various forms required for your divorce. You will be told in each case whether the form applies to you. Please find
Information sheet. This applies to you. Fill this out completely. The plaintiff is you, or the person seeking the divorce. The defendant is the other spouse... the one from whom the divorce is to be granted. Be sure to fill in every space. If the information requested does not apply to you please state that it does not apply to you. Do not leave any blanks on form.
Plaintiff's Special Power of Attorney. This applies to you. You do not have to fill it out, but you must sign it where indicated. You may ignore the request for a notary public. We will take care of that for you at this end.
Defendant's Special Power of Attorney. This applies to you only if your spouse is also signing the papers. That is, if this is a two-party divorce. This form does not have to be filled out, however it must also be signed where indicated. You may ignore the request for a notary public. We will take care of that for you at this end.
Affidavit. This applies to you (and your spouse if this is a two party case). It does not have to be notarized.

AFFIDAVIT
I/we ____________________________________________________ hereby submit my (our)self (selves) to the jurisdiction of the Courts of the Mexico for the sole purpose of obtaining a divorce. I/we have been advised that the Mexican divorce will not be recognized by the US Immigration and Naturalization service (INS). (IF APPLICABLE): I certify that my spouse will not submit to the jurisdiction of the Courts of Mexico and will not give consent to a divorce. I/we understand that any divorce judgment granted in any foreign jurisdiction without the consent of both spouses and without both spouses submitting to the jurisdiction of said foreign Court, and without an appearance personally by at least one of the parties to the divorce, must be considered avoidable and that the divorce judgment may be contested by either spouse and could be set aside by the Court in whose jurisdiction either spouse resides. I/we hereby release my/our attorneys, and the firms which they represent, from any responsibility for this divorce, and I/we assume full legal responsibility and consequences for this action for divorce for which I/we now petition the Courts of Mexico.
