Procedure for U.S. Court Divorce
Applicants must complete these forms and return it to us by mail, courier, or fax. Both spouses must complete and sign in from of a US Notary their own copy of the Petition of Waiver form. These signatures must be notarized and returned to us for filing in Court. If you are paying by credit card you must return the signed credit card authorization form.
The fee for this process is $1,500.00 *plus travel expenses
For a United States Court divorce it is necessary for both parties to consent in writing and for one of the parties to actually stay in Guam for 7 days.

GCA §8318, hereby conclusively waive any
objection which I may have as to the jurisdiction of the Superior Court of Guam
to grant a divorce or dissolution of marriage to either me or my spouse on the
grounds of irreconcilable differences and understand that such wavier shall
conclusively bar any future attack upon the jurisdiction of the Superior Court
of Guam to grant a divorce or dissolution of marriage to either me or my spouse
pursuant to the provisions of the codes of Guam, and further waive the right to
service of process provided:
1.
The petition is filed within 30 days of the date of this waiver;
2.
Within 5 days of its filing, a copy of the petition is personally served
on me or mailed to me by registered or certified mail to my address stated
above;
3. The Petition is only for the termination
of the marital status, and does not request the court to decide any issues
related marital or community property, spousal support, child support or child
custody or visitation.
With
respect to any such petition, I also waive any right to findings of fact and
conclusions of law, a record of testimony, motion for a new trial, notice of
entry of final judgment or decree, and the right to appeal; and
I
consent to the entry of an Interlocutory and Final Decree Dissolving the
marriage based on irreconcilable differences, and agree that the time for entry
of final judgment may be shortened pursuant to 19 GCA §8322.
